Terms of Service

The rules for using Databaset's API, dashboard, and hosted infrastructure.

1. Agreement to Terms

By creating an account, accessing our API, or using databaset.com, you agree to these Terms of Service and our Privacy Policy. If you use Databaset on behalf of a company, you represent that you have authority to bind that organization.

2. Description of Service

  • Databaset provides managed AI memory infrastructure: storage, embedding, semantic recall, and a developer dashboard
  • We may add, change, or discontinue features with reasonable notice for paid plans
  • Beta and preview features are provided as-is and may change without notice
  • Self-hosted deployments are governed by the MIT license for the SDK plus separate support terms if purchased

3. Account Registration

  • You must be at least 13 years old (16 in the EU where required)
  • Provide accurate registration information and keep it current
  • You are responsible for all activity under your account and API keys
  • Notify us immediately at app@databaset.com if you suspect unauthorized access
  • One free-tier account per individual; companies may hold multiple paid workspaces

4. Acceptable Use

You may:

  • Build commercial products and charge your customers
  • Store end-user data when you have lawful basis and proper consent
  • Use Databaset in production and development environments
  • Integrate with any LLM provider or orchestration framework

You may not:

  • Resell raw API access without a written reseller agreement
  • Store illegal content, malware instructions, or content that violates third-party rights
  • Attempt to probe, scan, or compromise our systems
  • Circumvent rate limits or usage metering
  • Use the service to send spam or unsolicited automated messages
  • Store special-category personal data (health, biometrics) without Enterprise DPA

5. API Usage

  • Rate limits and memory quotas apply per plan (see pricing page)
  • We may throttle or suspend accounts that degrade service for others
  • API keys must be kept secret; rotate keys if exposed
  • Use separate keys for production and staging
  • You must implement reasonable retry logic with exponential backoff

6. Payment Terms

  • Paid plans bill monthly or annually in advance via Stripe
  • Usage overages are billed at published per-memory rates
  • No refunds for partial billing periods except where required by law
  • We email before charging overages when possible
  • Accounts with failed payment may be suspended after 7 days
  • Price changes require 30 days notice to existing subscribers

7. Data & Privacy

  • You own the data you store in Databaset
  • You are responsible for obtaining consent from your end users where required
  • You must comply with GDPR, CCPA, and other laws applicable to your users
  • Our processing is described in the Privacy Policy; Enterprise customers may execute a DPA
  • On account termination you have 30 days to export data before deletion

8. Intellectual Property

  • Databaset owns the service, brand, documentation, and hosted infrastructure
  • You retain all rights to your applications and stored content
  • The @databaset/sdk is MIT licensed; attribution appreciated but not required
  • Feedback you provide may be used to improve the product without obligation to you

9. Warranties & Disclaimers

  • The service is provided "as is" and "as available"
  • We target 99.9% uptime on Growth and Enterprise but do not guarantee uninterrupted access
  • We do not warrant that recall results will be error-free for every query
  • You are responsible for evaluating fitness for your use case

10. Limitation of Liability

  • To the maximum extent permitted by law, our total liability is limited to fees paid in the prior 3 months
  • We are not liable for indirect, incidental, or consequential damages
  • These limits do not apply where prohibited by applicable law

11. Termination

  • You may cancel your subscription at any time from the dashboard
  • We may suspend or terminate accounts that violate these terms
  • We provide notice before termination except for severe abuse or legal requirements
  • Upon termination: export window of 30 days, then data deletion per Privacy Policy

12. Changes to Terms

  • Material changes notified by email 30 days in advance
  • Continued use after the effective date constitutes acceptance
  • Archived versions available on request at app@databaset.com

13. Governing Law

These terms are governed by the laws of India. Disputes shall be resolved in courts located in Bangalore, Karnataka, unless mandatory consumer protection laws in your jurisdiction require otherwise.
